Suffolk Claims Dismissed

Mold lawsuits can be difficult to stick.

A parent who filed against Suffolk Public Schools because her son suffered medical problems because of school mold has moved the case to federal court. Allegations are that the school knew of the mold, and did not fix it. The child has suffered rashes, vomiting, ear and sinus infections and faces long term medical treatment.

The judge disagreed on the nature of intent, so he dismissed the federal claim, leaving the state law claims of fraud, negligence and gross negligence. The lawsuit is asking for $7.8 million.
